EB-1A

Extraordinary Ability

For individuals with sustained national or international acclaim in the sciences, arts, education, business or athletics. Eligible applicants may self-petition and must intend to continue work in their area of expertise.

EB-2 NIW

National Interest Waiver

For advanced-degree professionals or people of exceptional ability whose proposed endeavour has substantial merit and national importance. A qualifying applicant may request a waiver of the job-offer and labour-certification requirements.

EB-3

Employer-Sponsored Residence

For skilled workers, professionals and certain other workers filling permanent, non-seasonal positions. A U.S. employer normally completes labour certification before filing the immigrant petition.

EB-5

Immigrant Investor Program

For applicants placing qualifying capital at risk in a U.S. commercial enterprise and satisfying the program's employment-creation requirements, through a direct or eligible regional-centre structure.

Decision standard

The route should follow the evidence—not the other way around.

Publications, awards, leadership, commercial impact, remuneration, peer recognition, education, employment history, proposed work, capital provenance and project risk may all matter, but they matter differently under each category.

Important considerations

Visa availability can depend on priority date and country of chargeability.

Meeting several evidentiary criteria does not make an EB-1A or NIW approval automatic.

EB-3 requires a genuine employer relationship and a compliant sponsorship process.

EB-5 capital is placed at risk; immigration review does not replace legal, tax, securities or commercial due diligence.
